Pool Pavilion Reservation Form

By submission of this form, I am agreeing to adhere to all stated rules.

FCHA'S POOL PAVILION RESERVATION FORM (RESIDENT USE ONLY)

MAXIMUM GUESTS ALLOWED IS 20 PEOPLE INCLUDING CHILDREN & PARENTS

This reservation DOES NOT include the exclusive rights and use of the pool, only the patio area and BBQ grill. There is a 4‑6 hour maximum for all reservations. Please note that the pool closes at 9.00 PM.

I understand that I have been granted use of the Fairview Commons Homeowners Association (“FCHA”) pool patio on the above date and time, subject to the following terms and conditions:

  1. Resident understands that the use of this facility is granted for residents use only and may not be reserved for a non-FCHA resident.
  2. A $100.00 refundable deposit will be required prior to any reservations.
  3. Resident agrees and understands that all underage functions MUST be always supervised by an FCHA adult resident. NOTE: ALL BABIES MUST WEAR SWIMMING DIAPER
  4. Resident agrees to defend, indemnify and hold harmless Fairview Commons Homeowners Association, Inc. its officers, directors, members, contractors, and agents from and against any suit, claim, loss or cause of action arising out of, or in conjunction with, the utilization of the pool or the areas in proximity to the pool by Resident pursuant to this Agreement. In addition, Resident agrees to reimburse Fairview Commons Homeowners Association, Inc. for any and all damages including but not limited to equipment, fixtures, furniture, or other property, either real or personal, arising out of the utilization of the recreational facilities, pursuant to this agreement, without regard to whether such damage is caused by Resident or is the result of the negligence or other fault of the Resident or Resident's guest.
  5. FCHA, its members, or Board Members will in no way be liable for loss, damages, or injuries to any resident or guest(s) in connection with this event. Resident assumes full responsibility and liability for any claims arising in connection with this event.
  6. Resident agrees to be responsible for their guest(s) and will maintain an orderly function, will allow no illegal activity on the premises, and will refrain from loud and unpleasant activities that may disturb other surrounding residents.
  7. Parking is limited; parking on grass, street or individual driveways is prohibited. (Violators will be subject to towing without warning. Towing is at the vehicle owner's expense).
  8. The pool gate door must always remain closed. Please do not open the door for anyone that is not in your party.
  9. Please, DO NOT tape, tack, nail, glue or attach anything to the walls.
  10. If the BBQ Grill is used it must be shut off and cleaned after use. There is a brush attached to the grill for this purpose. NO OUTSIDE GRILLS ALLOWED.
  11. Due to FCHA’s liability insurance, no “Bouncy House” rentals are allowed inside the gated area.
  12. Please read and adhere to all pool rules and regulations posted on the Pavilion wall facing the pool. No glass containers and water balloons are allowed inside the gated area.
  13. Resident agrees to return the premises to a neat, clean, and orderly condition and is responsible for removing and disposing of all trash and garbage created because of this event.
  14. If your party ends at 9.00 pm, please turn off all pool lights, can post lights, and bathroom lights.

THE FCHA RESERVES THE RIGHT TO POSTPONE OR CANCEL A POOL PARTY RESERVATION FOR ANY REASON INCLUDING ACC VIOLATIONS.

Declaration: I hereby declare that I have read and understood the Reservation Agreement and agree to abide by it. I further declare that I am responsible for my guests, their actions, and their adherence to the association’s rules and regulations.
